Pro Terms

1. About these Terms

These Petkey Pro Terms (“Pro Terms”) govern the use of a Petkey Pro account. They apply in addition to the Petkey Terms of Service and the Petkey Privacy Policy, which continue to apply in full. Where these Pro Terms and the Terms of Service conflict on a matter specific to Pro accounts, these Pro Terms govern.

“We”, “us” and “Petkey” mean Petkey, LLC. “You” and “your” mean the organization holding the Pro account and each individual who uses it.

2. Who may hold a Pro account

Petkey Pro accounts are available to professional organizations, including veterinary practices, animal shelters, rescues, breeders and animal control agencies.

  • The individual who opens and uses the account must be at least 18 years old and authorized to act on the organization’s behalf.
  • The organization is responsible for everything done through its account, including by its staff, contractors and volunteers.
  • Accounts may not be traded, sold, shared with or transferred to any other person or organization.

3. Verification

Access to Pro features requires verification. Verification is not automatic: an organization must apply for it and we grant it at our discretion.

  • We may require documentation before granting verification, and further documentation at any time afterwards.
  • You must tell us promptly if the information you gave us changes, or if your organization ceases to operate in the capacity for which it was verified.
  • We may suspend or withdraw verification at any time, with or without notice, and we are not required to give reasons.

4. What a verified Pro account can do

Verification allows your organization to look up the contact details recorded against a microchip number directly, so that you can reach a pet’s owner without going through us when a pet is found or presented to you.

This access applies whatever privacy setting the owner has chosen for their pet’s public profile. It exists so that a professional who has the pet can return it. It is a position of trust, and Section 5 sets the limits on it.

Verified accounts may also submit found-pet reports, and may be recorded on a registration either as the registrant of record while a pet is in your care or as an additional contact alongside the registrant of record, as described in Section 5 of the Terms of Service.

5. Permitted use of information — the core restriction

You may use the information you obtain through a lookup only to identify a pet and to contact its owner about that pet. You must not use it for any other purpose.

In particular, you must not:

  • use it for marketing, promotion or solicitation of any kind, whether your own or anyone else’s;
  • add it to, or use it to build or enrich, any mailing list, customer list, client record or database beyond what is necessary to care for or return the pet concerned;
  • sell, rent, license or otherwise make it available to any third party;
  • perform bulk, systematic or automated lookups, or scrape, harvest or extract data from the Services by any means. Look up a microchip number only when you have that pet in your care or before you, or are dealing with a specific report about it;
  • disclose it outside your organization, except as necessary to return the pet to its owner or where required by law;
  • retain it for longer than you need it for that pet.

These restrictions bind every individual who uses your account. Make sure your staff know them.

6. Lookups are limited and logged

We limit lookups and we log them. Each lookup is recorded against your account.

  • We may audit lookup activity and ask you to explain a particular lookup or pattern of lookups.
  • Where a pet owner reports that their information may have been misused, we will investigate, and we may withdraw your access.
  • Repeated or serious breach of Section 5 will result in withdrawal of verification and may result in closure of the account.

7. Protecting the information you see

The contact details you obtain are another person’s personal information. Treat them accordingly.

  • Keep them confidential and secure, and handle them in compliance with applicable privacy and data protection law.
  • Give each member of staff their own login. Do not share credentials or use a generic account.
  • Tell us promptly if you suspect any unauthorized access to or use of your account.

8. Pets in your care

Where a pet is surrendered to or taken in by your organization, we can record your organization against the microchip while the pet is in your care, so that you are the point of contact if it strays. A registration recorded in this way is temporary, carries no Petkey Plus benefits, and does not use up the Standard (Lifetime) Registration available for that pet.

Where a pet is adopted from your organization, the adopter completes a Standard Registration in their own name. The transfer routes, fees and documentation requirements set out in Section 5 of the Terms of Service apply.

You must not record your organization, or any individual, as the owner or keeper of a pet you are not lawfully entitled to be recorded against. You are responsible for the accuracy of everything you submit to us, including surrender, intake and adoption documentation.

9. Petkey is neutral in ownership disputes

Petkey provides a registration service and is neutral in any dispute over the ownership or possession of a pet. We do not investigate, mediate, adjudicate or determine ownership, and we are not responsible for resolving disputes between current or former owners, family members, breeders, organizations or any other parties.

10. Suspension and termination

We may suspend or terminate a Pro account, or withdraw verification, at any time, including where we believe these Pro Terms have been breached. You may close your account at any time by contacting us. Sections 5, 6, 7, 9, 11 and 12 survive termination.

11. No warranty

The Services are provided on an “as is” and “as available” basis. We do not warrant that a microchip lookup will return a result, that any information returned is accurate or current, or that a pet will be identified or returned. Registration records depend on information provided by pet owners, and we do not independently verify it.

12. Limitation of liability

To the fullest extent permitted by law, Petkey is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of, or inability to use, the Pro features, including any decision taken on the basis of information obtained through a lookup.

You are responsible for your own use of the information you obtain, and you agree to indemnify Petkey against any claim arising from your use of it in breach of these Pro Terms.

13. Changes to these Pro Terms

We may update these Pro Terms. Where a change is material, we will give notice before it takes effect. Continuing to use a Pro account after a change takes effect means you accept the updated Pro Terms.

14. Governing law

These Pro Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions, and the dispute resolution provisions of the Petkey Terms of Service apply.
